Motorola class action lawsuit overview:

  • Who: Clare Spottiswoode filed a class action lawsuit against Motorola Solutions UK Ltd., Motorola Solutions Inc. and Airwave Solutions Ltd.
  • Why: Spottiswoode argues Motorola charged excessive and unfair prices for emergency services in Britain to use Airwave, its secure radio network.
  • Where: The Motorola class action lawsuit was filed in the Competition Appeal Tribunal.

Motorola charged excessive and unfair prices for emergency services in Britain to use Airwave, its secure radio network, a new £650 million class action lawsuit alleges.

Plaintiff Clare Spottiswoode, a former energy regulator head, claims Motorola is able to charge the allegedly higher prices due to its dominant role in the market and that it breached competition law by doing so, Law360 reports.

Motorola reportedly purchased Airwave, which provides emergency services a secure way to communicate, in 2016.

Spottiswoode, who filed the complaint with the Competition Appeal Tribunal, wants to represent 400-2,000 class members whom she argues paid more to use the Airwave network between 2020-2023, Law360 reports.

CMA investigation found Motorola charged too much for Airwave use, class action claims

The complaint closely resembles the findings of a Competition and Markets Authority investigation that reportedly determined Motorola charged too high of a price for the Airwave network.

The agency ordered Motorola to lower the cost to use Airwave, Law360 reports.

Motorola has reportedly since challenged the agency’s findings in the Court of Appeal and is awaiting a decision. The telecommunications giant previously lost an August 2023 challenge to the Competition Appeal Tribunal, which upheld the CMA’s findings.

In a previous case filed with the Competition Appeal Tribunal in August 2022, consumer rights expert Alex Neill argued Sony overcharged consumers
