Uber Drivers Discrimination Class Action Lawsuit Overview: 

  • Who: Uber drivers and couriers are filing a class action lawsuit against the ride hailing and food delivery company.

Uber’s face verification technology is “inherently faulty” and discriminates against people of colour, a new class action lawsuit alleges. 

The App Drivers & Couriers Union (ADCU) claims the biometric identity checks performed by Uber to verify its drivers in the UK don’t always work properly with drivers of colour.

The ADCU claims the verification checks led to the unfair dismissal of former Uber driver Imran Javaid Raja and former Uber Eats courier Pa Edrissa Manjang.

Raja and Manjang were let go from Uber after they failed verification checks done using the company’s facial recognition technology, according to the ADCU.  

Uber implemented the facial recognition technology last year after the Westminster Magistrates Court ruled the company needed to “maintain appropriate systems, processes and procedures to confirm that a driver using the app,” is licensed and permitted to use the app, according to the ADCU.

The ADCU says it plans to argue that facial recognition systems used by Uber are “inherently faulty and generate particularly poor accuracy results when used with people of colour.”  

Uber Drivers Say Tech Co Discriminates Against Minorities 

Uber was also on the receiving end of a class action lawsuit filed last year by a former driver alleging the company violated the US Civil Rights Act by firing minority drivers based on their passenger ratings, according to Fortune

The class action lawsuit was filed on the heels of the company releasing an ad campaign which implored users who tolerate racism to “delete the app.” 

ADCU President Yaseen Aslam said in a statement that Uber has not only failed to eliminate racism within the company but has instead made it worse by implementing faulty and discriminatory technology. 

“Last year Uber made a big claim that it was an anti-racist company and challenged all who tolerate racism to delete the app,”  Aslam said. “But rather than root out racism Uber has bedded it into its systems and workers face discrimination daily as a result.” 

Uber drivers in the UK have successfully pursued litigation against the company before, including a Supreme Court ruling made earlier this year that concluded the ride hailing services’ drivers are employees and not independent contractors.
