Do You Qualify to Join the easyJet Group Action?

UK law firms are accepting claims against easyJet over allegations that the airline failed to protect consumers’ personal information. Read below to see if you qualify and learn how to file a claim.

What is This Claim About?

The easyJet group action claims customers affected by the company’s data breach were not notified cyberattackers reportedly stole personal details – including email addresses and credit card information — until after four months had passed.

Who’s Eligible?

You may be eligible to join the easyJet group action claim if you booked a flight with the airline from 17 Oct. 2019 to 4 March 2020, and were notified of the data breach by the Information Commissioner’s Office (ICO), according to law firm Hayes Connor.

The law firm also states that 51 reports fraud have stemmed from the easyJet data breach.

In total, affected customers lost an alleged £11,752.81.

You do not need to prove you lost money directly from the data breach in order to join the group action, according to the European Union’s General Data Protection Regulations.

How Much Compensation Will I Receive?

The total amount of compensation in the easyJet group action has not been determined yet, but the total amount could be in the realm of £18 billion in damages. Each claimant could receive up to £2,000.

Following an easyJet data breach in which 9 million customers had their personal and financial details accessed, affected customers have filed a group action seeking damages for the cyberattack, according to the New York Times.

The easyJet group action is seeking up to £18 billion in damages, meaning each claimant could receive compensation of up to £2,000. 

The easyJet data breach occurred in January, but customers were not notified until the airline disclosed the data breach leak in mid-May.

EasyJet reported the data breach to the Information Commissioner’s Office in January, but the easyJet group action alleges that customers were not told until months had passed. 

Europe’s General Data Protection Regulation (GDPR) Article 82 declares that it is the right of consumers to be compensated for the “distress” and “loss of control” of their personal and financial data. 

“The breach took place in January 2020, meaning it took four months for easyJet to notify its customers,” stated PGMBM, one of the law firms representing claimants in the easyJet data breach class action lawsuit.

In the easyJet data breach, cybercriminals accessed travellers’ email addresses and travel details. The cyber attackers also obtained 2,200 customers’ credit card information in the easyJet data breach, including the three-digit security codes on the cards. Personal passport information was not accessed.

The airline has informed customers impacted by the easyJet data breach to be cautious and keep an eye out for phishing scams. The cyber attackers may try to defraud victims of the easyJet data breach.

An easyJet plane on a runway - easyjet data breachThe GDPR allows claims for nonmaterial damages in the easyJet group action. This means claimants do not need to prove they have endured a direct financial loss in order to be entitled to compensation.

The easyJet group action will also grant EU citizens access to seek compensation if they were also affected by the cyberattack. 

The class action lawsuit over the easyJet data breach was filed May 22, 2020.

According to lawyer Tom Goodhead at PGMBM, 43 Class Members were involved in the easyJet group action in June, and more claimants may have joined. PGMBM has awarded conditional fee arrangements to another 6,000 claimants, and an additional 25,000 claimants wish to join the easyJet group action.

EasyJet’s CEO Johan Lundgren apologised to the data breach’s impacted customers in a statement.

“We take the cyber security of our systems very seriously and have robust security measures in place to protect our customers’ personal information,” he said. “However, this is an evolving threat as cyber attackers get ever more sophisticated. Since we became aware of the incident, it has become clear that owing to COVID-19 there is heightened concern about personal data being used for online scams. As a result, and on the recommendation of the ICO, we are contacting those customers whose travel information was accessed and we are advising them to be extra vigilant, particularly if they receive unsolicited communications.”

He continued: “Every business must continue to stay agile to stay ahead of the threat. We will continue to invest in protecting our customers, our systems, and our data. We would like to apologise to those customers who have been affected by this incident.”

The easyJet Data Breach Group Action was filed by PGMBM in the High Court of London, England.
