Teletext, Alpharooms Refund Policy Overview:

  • Who: The High Court has ruled that Teletext Holidays and Alpharooms travel agents broke consumer law with their refund policies
  • Why: The travel agents refusing to issue customers refunds for trips canceled due to the pandemic, in violation of Package Travel and Linked Travel Arrangements Regulations
  • Where: UK High Court

Two package holiday travel agents broke the law when they failed to refund customers within the legally-required time frame after their trips were canceled due to the pandemic, the High Court has ruled.

On Feb. 28, the court ruled that Truly Travel Ltd and Alpha Holidays Ltd – which traded as Teletext Holidays and Alpharooms respectively – breached the Package Travel and Linked Travel Arrangements Regulations (PTRs), the Competition and Markets Authority (CMA) announced in a press release.

While the regulations required the companies to refund customers for package holidays that were cancelled due to the COVID-19 pandemic within 14 days, the companies did not issue refunds at all. The CMA sued them last year. Both companies are now in liquidation.

“This should be a wake-up call to any business that thinks that it doesn’t need to honour customers’ refund rights,” CMA Chief Executive Andrea Coscelli said. “We hope the decision will make it easier for people to get their money back for a cancelled holiday in the future.”

Despite the firms being in liquidation, the CMA sought a declaration from the High Court in this case to highlight the importance of travel firms respecting consumers’ refund rights, it said.

The authority said it had been working to clean up the package travel sector, and had secured hundreds of millions of pounds in refunds so far for those whose holidays were cancelled due to the pandemic.

Teletext Holidays and Alpharooms package travel customers with outstanding refunds are being asked to submit a claim to the Travel Trust Association, due to the companies’ liquidation status.

Meanwhile, the Department for Transport announced last month that it plans to overhaul air passengers’ compensation for flights within the United Kingdom.

The DfT is proposing a compensation scheme similar to the one used to compensate passengers for train delays. Like the train compensation scheme, the amount of the air passenger’s refund would depend on the ticket price and the length of the delay.
