Law firms in the United Kingdom are seeking claimants whose personal information was leaked by a London clinic in September 2015.
The recipients of a 56 Dean Street clinic email were able to see each other’s email addresses, rather than everyone being blind copied, according to the BBC.
The clinic focuses on sexual health. It is operated by Chelsea and Westminster Hospital NHS Foundation Trust.
Because of the email blind-copy error, 781 people who had visited HIV clinics and signed up for a newsletter were able to see the names and email addresses of other patients, the BBC reported.
According to 56 Dean Street, not everyone who received the email was HIV positive, but nearly all the email addresses contained their owners’ full names, the BBC reported.
An investigation into the matter by the Investigation Commissioner’s Office (ICO) found the trust made a similar mistake in 2010.
“That our investigation found this wasn’t the first mistake of this type by the Trust only adds to what was a serious breach of the law,” Information Commissioner Christopher Graham said, according to the BBC.
In May 2016, the ICO fined the 56 Dean Street clinic £180,000 because of the breach, Wired reported.
Clinic medical director Zoe Penn said the clinic accepted the ICO’s decision and had made procedural changes.
“The immediate safeguards we have put in place at Dean Street have included deleting the original email distribution list, limiting the opportunity of group email distribution, making the Option E Newsletter available only from the public website and, where group email is required, putting a two hour delay on recipients receiving group emails,” the clinic said in a statement, according to Wired.
Law firms representing those affected by the 56 Dean Street data leak say solicitors for the Chelsea and Westminster Hospital NHS Foundation Trust have accepted liability for the cases that are underway.
While some deadlines have passed, according to Group Action Lawyers, there may still be time to pursue compensation.
