Do You Qualify to Join the Nissan and Renault Group Action?

UK law firms are accepting claims against Nissan and Renault over allegations that the automakers used defeat devices to cheat emissions tests. Read below to see if you qualify and learn how to file a claim.

Nissan and Renault are facing a class action lawsuit seeking damages for claimants after 1.4 million vehicles were alleged to be equipped with unlawful “defeat devices.”

The defeat devices are designed to trick emissions tests, so affected models are emitting much higher emissions than allowed.

Drivers of certain vehicles may be unknowingly polluting the air.

Who’s Eligible?

You may qualify to join the Nissan and Renault emissions class action lawsuit if you bought or leased one of the following vehicles in England or Wales. The models were manufactured between 2009 and 2019.

How Much Compensation Will I Receive?

If the Nissan emissions class action lawsuit succeeds, qualified Class Members could receive thousands of pounds in compensation.

While the exact amount is not yet known, it could be up to £10,000 per vehicle, according to law firm PGMBM. Lawyers are working to obtain for claimants the full cost of their vehicle, if the class action is successful.

U.K. law firms are accepting claimants in a group action against Nissan and Renault.

In July, a class action lawsuit was launched after 1.4 million Renault and Nissan vehicles were alleged to have been fitted with illegal defeat devices used to cheat emissions tests. About 1.3 million Renault and Nissan diesel vehicles and another 100,000 petrol-powered Nissan Qashqais were alleged to be illegally creating dirty air.

The Nissan emissions class action lawsuit, filed by law firm Harcus Parker, claimed the Nissan emissions were cheating tests by up to 15 times the legal U.K. limit, according to the BBC. The law firm petitioned for a freedom of information request from the Department of Transport and reportedly found that 100,000 1.2-litre Nissan Qashqais were among the biggest violators of Nissan emissions.

Harcus Parker alleges up to 700,000 Renault diesel vehicles and 600,000 Nissan vehicles in the U.K. could be equipped with the illegal defeat devices, meaning those vehicles are spewing emissions higher than they should be, according to evidence from an independent study.

According to the Nissan emissions class action lawsuit, the models that might be fitted with emissions defeat devices are the Nissan Juke, Note, Qashqai and X-Trail, and Renault’s Captur, Clio, Espace, Megane and Scenic. All models equipped with emissions cheat devices were built between 2009 to 2018.

However, both Nissan and Renault firmly deny the defeat device allegations.

According to the law firm, the freedom of information request disclosed that the government tried to step in to fix the Nissan emissions problem by recalling the vehicles, but Nissan denied the government’s approach.

Renault hood ornament on black vehicle - nissan emissionsThen, in September 2017, Nissan was allegedly sent a statement from the Department for Transportation, which said: “A petrol Nissan Qashqai was selected for testing this year. We have now completed this testing, and we found that when conducting NEDC tests on a test track and conducting a Real Driving Emissions test, NOx (nitrogen oxide) emissions results were very high for this vehicle.”

The Department for Transportation wrote Nissan again in 2018, reportedly reminding them the Qashqai was “not sufficiently well designed to control the NOx in real-world conditions.”

The defeat devices in the vehicles allegedly turn on emission controls during tests, but turn the controls off in real-world road conditions. The system is meant to improve driving performance and reliability. 

In a statement to Autocar, Nissan UK and Renault UK denied the allegations that their vehicles were equipped with illegal defeat devices.

“Nissan has not and does not employ defeat devices in any of the cars that we make, and all Nissan vehicles fully comply with applicable emissions legislation,” Nissan’s statement said. “The initial report from 2017, which looked at the variation between lab and ‘real world’ conditions, showed variances for most brands involved. It also stated that the Nissan tested complied with all required regulatory limits.”

“All Renault vehicles are, and always have been, type-approved in accordance with the laws and regulations for all the countries in which they are sold and are not fitted with ‘defeat devices,’” Renault said.

“For the first time, we have seen evidence that car manufacturers may be cheating emissions tests of petrol as well as diesel vehicles,” said lawyer Damon Parker of Harcus Parker.  

He added: “We have written to Renault and Nissan to seek an explanation for these extraordinary results, but the data suggests that these vehicles, much like some VW and Mercedes cars, know when they are being tested and are on their best behaviour then and only then.”

The Nissan emissions class action lawsuit’s lawyers note that Nissan and Renault customers paid too much when purchasing their vehicles because they were fitted with illegal defeat devices.

Harcus Parker wants the claimants in the Nissan emissions class action lawsuit to be compensated. The firm says owners of affected vehicles could receive up to £5000 each. Any owners of the impacted vehicles are urged to join the class action lawsuit.

    I do not want to lodge any sort of emission claim against Nissan.Please cancel if i am on your books as a claimant.If there has been a claim lodged it was not done by me.I have discovered a claim was done by my youngest son with no authority given by myself using my smartphone.My reg is LY59LHK.Thank you.
