Children’s Health Ireland has reportedly agreed to pay €7.5 to end a lawsuit claiming the hospital “missed opportunities” on three occasions to diagnose and begin treating a young child’s brain tumour.  

The boy, who is now 11-years-old, and his family filed a lawsuit against Children’s Health Ireland, administrator of the Children’s University Hospital Temple Street, Dublin, reports the Irish Times. They alleged that they sought medical help from the hospital in 2012 when the child was a toddler with concerns about the boy’s speech and walking problems.  

Their lawsuit, reportedly lodged in High Court against Children’s Health Ireland, alleged that diagnostic procedures were scheduled months and even a year out in one instance. They also claim that, during one hospital visit in March 2013, their child’s walking problems were attributed to differing leg lengths.  

The brain tumour was not discovered until May 2013 when an MRI scan revealed a significantly large mass. The boy had emergency surgery in 2013 after the MRI, as well as chemotherapy and another surgery.  

The boy, who is reportedly anonymous by order of the court, claims that medical professionals failed at least three times to diagnose the tumour earlier, subjecting him to unnecessary pain and suffering. Further, earlier diagnoses of his brain tumor in 2012 when his parents first sought medical treatment would have likely resulted in a more favorable outcome, alleged the lawsuit.  

Under the terms of the settlement Children’s Health Ireland does not admit to failing to carry out adequate assessment and perform a full neurological examination. Lawyers for the hospital reportedly argued that the boy’s brain tumour grew slowly and an earlier diagnosis would not have made a difference in the outcome.  

High Court Justice Kevin Cross approved the proposed €7.5 million settlement and wished the boy and his family well, reports the Irish Times.
