Google DeepMind Health Data Sharing Class Action Lawsuit Overview:

A consumer has lobbied a class action style lawsuit against Google and DeepMind Technologies in response to a 2016 health data sharing scandal in the UK.
The complaint seeks redress for claims that Google’s artificial intelligence division, DeepMind, received the health data of more than a million UK patients without their knowledge or consent, TechCrunch reports.
Plaintiff Andrew Prismall claims Google and DeepMind unlawfully used patients’ confidential medical records and is seeking damages on behalf of an estimated 1.6 million potential class members.
The data share was part of an app development project being conducted by the Royal Free NHS Trust in London, TechCrunch reports.
DeepMind, Royal Free NHS Trust Worked To Develop Healthcare App
The UK’s data protection watchdog sanctioned the Royal Free NHS Trust in 2017 after the agency found it was in violation of UK data protection law by sharing patient data with DeepMind.
DeepMind, meanwhile, avoided sanctioning after the watchdog determined that the Royal Free NHS Trust was directly responsible for sending the patients’ health data to the tech firm, TechCrunch reports.
The Royal Free NHS Trust and DeepMind reportedly worked to develop an app that would alert clinicians if a patient was in the early stages of suffering from an acute kidney injury.
Prismall filed a similar class action lawsuit against Google and DeepMind last September but was later discontinued, TechCrunch reports.
In February, Google got the okay from the Competition and Markets Authority (CMA) to replace third-party cookies in its Chrome internet browser with a new development it is calling Privacy Sandbox.
The CMA had been monitoring the new development after it received complaints that it could potentially be used by Google to assert a monopoly over the advertising market and be an abuse of power.
